Collaborative LawCollaborative law is a fairly new approach to the resolution of divorce disputes. Unlike mediation, which employs a neutral third party to help the spouses come to a mutually beneficial resolution of their disputes, collaborative law retains the lawyer-client relationship. Both parties agree not to take the dispute to litigation, but benefit from the legal expertise of their lawyers as they negotiate a resolution to their dispute. If either party decides to terminate the collaborative approach and proceed with litigation, each party must hire a new attorney. The collaborative approach encourages cooperation between the parties, but provides a more formal approach than mediation.
